You had better test this in Firefox in a restricted real estate. If your menu is long (and scrolling) in a limited area, you may find that selection is odd.
It is a bug that can be difficult to replicate if you got things just right, but you should check.

I have also seen this problem. I have tried the buildAfterLoad=true; global property without affect. My menus are embedded in a table within an absolutely positioned div.
